| These are the terms and conditions which govern the provision of the goods and/or service to you. |

| Who you contract with |
|
|
1.

You contract directly with Activity Superstore not with London Marketing. |
|
|
|
|
| The point at which you contract |
|
|
1.
|
Completing your booking form and submitting it to us amounts to an offer to contract. Such offer is accepted and a binding contractual agreement is entered into between you and Activity Superstore, when a booking confirmation number is sent to you. The act of sending the booking confirmation number is contractual acceptance. |
|
|
|
2.
|
If you book online you will receive a booking confirmation voucher by email within 12 hours after your online booking is completed. |
|
|
|
3.
|
If you book over the telephone, you will receive a booking confirmation number via your chosen means of communication. |
|
|
|
|
| When you pay |
|
|
1.
|
You pay at the time of purchase and your credit card is debited by Activity Store at the time when or shortly after the confirmation email is sent. |
|
|
|
|
| Your obligations if you do not receive a booking confirmation voucher |
|
|
1.
|
If your chosen means of receiving booking confirmation is by email (you have no choice if you book online) and you do not receive a booking confirmation number within 12 hours after your online booking is completed, it is your responsibility to immediately contact us on customerservice@LondonTown.com or by telephone on 44 (020) 7437 4370 |
|
|
|
2.
|
If your chosen means of receiving a booking confirmation number is via non-electronic means and you do not receive a booking confirmation number within 3 working days if you are in the UK and 14 working days if you are outside of the UK, it is your responsibility to immediately contact us on customerservice@LondonTown.com or by telephone on 44 (020) 7437 4370 |

|
| Your booking confirmation voucher is important! |
|
|
1.
|
It is your responsibility to check that all the information on the booking confirmation voucher ("voucher") is correct (name, date and time of event etc). Please contact us immediately (time being of the essence) at customerservice@LondonTown.com or by telephone on 44 (020) 7437 4370 if it is not. |
|
|
|
2.
|
To be supplied with the activity on the voucher, the person named on the voucher must present the voucher to the relevant supplier prior to the longstop date specified on the voucher. |
|
|
|
3.
|
In making a booking with the relevant supplier, you will be deemed to have accepted the supplier's terms and conditions of trade and you should, in particular, note the clauses dealing with cancellation of bookings and limitation of liability. A copy of the supplier's terms can be obtained from us or Activity Superstore on request. |
|
|
|
|
| The terms on which you contract |
|
|

|
Activity Superstore or your chosen independent supplier may supply you with a set of their own terms and conditions at the time of or after you have placed your booking with them. London Marketing has endeavoured to reflect the main terms and conditions herein but shall not be liable to you for any omission or failure to have done so. |
|
|
|
2.
|
To the extent that Activity Superstore's or your chosen independent supplier's terms and conditions are inconsistent with these terms and conditions, Activity Superstore's or your chosen independent supplier's terms and conditions shall prevail. |
|
|
|
|
| Cancellations and Refunds |
|
|
1.
|
Once you receive a voucher, and you have confirmed (explicitly or implicitly) that the information on it is correct, you may not cancel you booking under any circumstances. |
|
|
|
2.
|
You shall only be entitled to a full refund of the original voucher price if your original booking is cancelled by the supplier of your activity and a suitable alternative is not available. |
|
|
|
|
| Our liability to you |
|
|
1.
|
To the maximum extent permitted by law, London Marketing shall not be liable to you for any injury, loss (including but not limited to personal property), damage, delay, expense, inconvenience or otherwise suffered as a consequence of anything, howsoever caused, in connection with the provision of the event. |
|
|
|
2.
|
To the extent that London Marketing is held liable, London Marketing's liability shall not exceed the value of the goods and/or services contracted for. |
|
|
|
|
| Health and Age Restrictions |
|
|
1.
|
You are required to notify the event supplier of any relevant medical condition. If you are in any doubt whether you are fit enough to participate in the event, you should seek the advice of your doctor. |
|
|
|
2.
|
Unless otherwise stated in your supplier's brochure and/or at the time of presenting your voucher to the supplier, the minimum age for any activity is |
|
|
|
|
| Personal Accident Insurance |
|
|
1.
|
The price of the voucher includes the cost of providing you with personal accident insurance cover. |
|
|
|
2.
|
Personal accident insurance cover is arranged with QBE Leisure & Sport under Master Policy Number 40268 PEBD2RCBP. |
|
|
|
3.
|
If you sustain an injury during the course of your activity, you may be entitled to claim compensation in accordance with the following schedule after the total claim has been substantiated. Compensation is payable per insured person in respect of an accident as set out below. Please note that accidental death benefit is restricted to a maximum of £5,000, for persons under the age of 16 years:
Death up to £100,000
Total & irrecoverable loss of both eyes up to £100,000
Total & irrecoverable loss of one eye up to £100,000
Loss of two limbs up to £100,000
Loss of one limb up to £100,000
Total & irrecoverable loss of one eye & loss of one limb up to £100,000
Permanent total disablement (other than total loss of sight in one or both eyes or loss of limb) |

|
4.
|
The above benefits are payable only upon bodily injury (as described above) or accidental death during the period of insurance i.e. whilst the insured is carrying out activities in connection with and under the direction of either Activity Superstore or another independent supplier. |
|
|
|

|
The schedule above is for guidance only and does not form part of the policy document or represent a full statement of all terms and conditions applicable. |
|
|
| Obligation to comply with foreign laws |
|
|
1.
|
You shall comply with all laws of the country in which you are physically located and which apply to you when entering into the contract with Activity Superstore or your chosen independent supplier, including without limitation consumer law and export control laws and regulations. |
|
|
|
|
| Data protection and you |
|
|
1.
|
London Marketing is the data controller of your data. London Marketing is registered under the Data Protection Act 1998 (DPA) and London Marketing complies with the DPA in all our dealings with your personal data. |
|
|
|
2.
|
When entering into a contract with Activity Superstore or your chosen independent supplier, you consent to London Marketing processing your personal data to the extent necessary to ensure that Activity Superstore or your chosen independent supplier can supply to you the event. This processing will include, but not be limited to, passing on your personal information to Activity Superstore or your chosen independent supplier for the purposes of enabling them to provide the event to you. London Marketing makes no representation or warranties, and shall not be liable to you in the event that Activity Superstore or your chosen independent supplier is not registered under the DPA and/or does not comply with the DPA in their dealings with your personal data. |

|
|
| Rights of Third Parties |
|
|
1.
|
These Terms do not create any rights under the Contracts (Rights of Third Parties) Act 1999 ("Act") which are enforceable by any person who is either not a party to them or who is not Activity Superstore or your chosen independent supplier. |
|
|
|
|
| General |
|
|
1.
|
You accept and hereby acknowledge that that attendance and participation in the event is entirely voluntarily and at your own risk. |
|
|
|
2.
|
Where Activity Superstore is not designated as the supplier, it has made every effort to ensure that the independent supplier is a safe and reputable organisation. The supplier acts as an independent contractor in providing the activities and is neither employed by nor acting as an agent on behalf of Activity Superstore. Although Activity Superstore has visited many of its suppliers it is unable to examine all the equipment or facilities of all of its suppliers or to vet their employees. Consequently Activity Superstore cannot accept responsibility for any act or omission or negligence of the supplier nor any other liability arising out of the provision of the activities to you. |

|
3.
|
The supplier of an event reserves the right to make reasonable changes to the programme of any activity so long as these do not affect to any material extent the nature and scope of such activity. |
|
|
|
4.
|
Due to the nature of some of the activities, these may be subject to cancellation due to weather conditions or other matters (e.g. mechanical breakdown) beyond the control of the supplier. |
|
|
|
5.
|
The timing of any activity is given as a guide only and you may be required to wait for your turn along with other members of the public. |
|
|
|
6.
|
The supplier reserves the right to reschedule the timings or location of any activity, possibly at short notice, owing to unavailability of the activity, booking numbers or any other factor beyond the control of Activity Superstore. |
|
|
|
7.
|
These terms and conditions shall be governed by and construed in accordance with the laws of England. |
|
|
|
8.
|
You irrevocably submit to the exclusive jurisdiction of the courts of England to settle any dispute which may arise out of or in connection with these terms and conditions. |
|
|
|
9.
|
Where relevant, you may print and keep a copy of these terms and conditions. |
|
|
|
10.
|
If any part of these terms and conditions is held unenforceable, that part shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties, and the terms and conditions shall continue in full force and effect. |
