UNIQUE EXPERIENCES

 

These are the terms and conditions which govern the provision of the goods and/or service to you.

 

London Marketing

1.

www.LondonTown.com (the "Website"), 0800 London and LondonTown.com kiosks are owned and managed by London Marketing.com Limited with registered company number 03189585 and VAT number 681614724 ("London Marketing"). London Marketing manages all information supplied through these channels.

 

2.

Who you contract with

1.

You contract directly with your chosen Unique Experience provider and not London Marketing.

 
 

The point at which you contract

1.

Completing your booking form and submitting it to us amounts to an offer to contract. Such offer is accepted and a binding contractual agreement is entered into between you and your chosen Unique Experience provider, when a booking confirmation number is issued and displayed to you, either on screen or in a communication sent to you. The act of issuing the booking confirmation number and notifying you of the same is contractual acceptance.

 

2.

If you book online you will receive a booking confirmation number by email within 12 hours after your online booking is completed.

 

3.

If you book over the telephone, you will receive a booking confirmation number via your chosen means of communication.

 
 

Restrictions Apply!

1.

You are required to notify London Marketing and your chosen Unique Experience provider of any relevant medical condition.

 

2.

Please be aware that there are often age, health, height and other such restrictions apply which may prevent you from enjoying a Unique Experience. Please therefore ensure you carefully read the restrictions associated with your chosen Unique Experience ("Restrictions") and check that you comply with them fully before making a booking.

 

3.

If you are in any doubt, please do not hesitate to contact our customer services department by telephone on 44 (020) 7437 4370 who will be able to help.

 
 

When you pay

1.

Unless otherwise stated at the time of making your booking, your credit card details will only be used to secure your booking and no monies will be deducted from your credit card at this stage.

 

2.

Unless otherwise stated at the time of making your booking, you will pay your chosen Unique Experience provider when you arrive to enjoy your Unique Experience and you may choose to pay with another credit card.

 

3.

Please be aware that some Unique Experience providers only accept payment in cash upfront on the day of the Unique Experience. In this event, we will advise you at the time of your booking.

 
 

Your obligations if you do not receive a booking confirmation number

1.

If your chosen means of receiving a booking confirmation number is by email (you have no choice if you book online) and you do not receive a booking confirmation number within 12 hours after your online booking is completed, it is your responsibility to immediately contact us on customerservice@LondonTown.com or by telephone on 44 (020) 7437

 

2.

If your chosen means of receiving a booking confirmation number is via non-electronic means and you do not receive a booking confirmation number within 3 working days if you are in the UK or 14 working days if you are outside of the UK, it is your responsibility to immediately contact us on customerservice@LondonTown.com or by telephone on 44 (020) 7437

 
 

You must check the information in our email or letter of confirmation

1.

It is your responsibility to check that the information contained in our confirmation email or letter is correct and to immediately contact us on customerservice@LondonTown.com or by telephone on 44 (020) 7437 4370, if any of the details are not correct.

 
 

Your booking confirmation number is important!

1.

You must take your booking confirmation number with you to your chosen Unique Experience venue. If you experience booking difficulties at any time, please contact the LondonTown.com Assistance Centre by email at customerservice@LondonTown.com or by telephone on 44 (020) 7437

 
 

The terms on which you contract

1.

Your chosen Unique Experience provider may provide you with a set of their own terms and conditions after you have placed your booking with them. London Marketing has endeavoured to reflect the main terms and conditions of your Unique Experience provider herein but shall not be liable to you for any omission or failure to have done so.

 

2.

To the extent that your Unique Experience provider's terms and conditions are inconsistent with these terms and conditions, your Unique Experience provider's terms and conditions shall prevail.

 
 

Cancellation by you

1.

Unless otherwise indicated at the point of purchase, you may not cancel your Unique Experience. For the avoidance of doubt, if you arrive at your Unique Experience venue and decide for any reason not to partake or you fail to arrive at your chosen Unique Experience venue, you will be subject to a no-show fee equivalent to the full cost of your Unique Experience (inclusive of any taxes), which may be charged to your credit card without further notice to you.

 
 

Cancellation by your Unique Experience Provider

1.

In the unlikely event that circumstances beyond our control (such as weather) require London Marketing, or a Unique Experience provider to cancel your Unique Experience, the relevant party will tell you as soon as practicable and will use reasonable endeavours to offer an alternative. Where an acceptable alternative cannot be arranged, you will be entitled to a full refund of any payment already made.

 
 

You pay the price you see

1.

The price quoted at the time of making your booking on LondonTown.com is the price you will pay for your Unique Experience and includes all taxes. Any discrepancies should be addressed with your chosen Unique Experience provider at the time. If unresolved you should contact LondonTown.com Assistance Centre at email customerservice@LondonTown.com or on telephone 44 (020) 7437

 
 

Transferability

1.

Unless otherwise stated, you may change any details relating to your booking (by phone or by using the http://www.LondonTown.com/cancel facility) any time up to 5 clear working days prior to the day of your booking.

 

2.

Should you decide to change any details relating to your booking, your Unique Experience provider will do its best to accommodate such arrangements, but shall not be held liable for any failure to do so or if the original price no longer applies.

 

3.

Different prices may be applicable and, in the event that the new price is cheaper than the old price, your Unique Experience provider reserves the right to not refund you the difference.

 
 

Your Unique Experience

1.

Please note that the descriptions of the Unique Experiences on the Website are intended as summaries only. The stated schedule and duration of Unique Experiences are guides only and may differ slightly. Exact timing will depend on the weather, time of year, centre capacity etc. Where the Unique Experience is taken as part of a small group then please be aware that there may be some waiting time involved.

 

2.

We make every effort to ensure that you are happy with your Unique Experience. However, occasionally some changes may need to be made due to circumstances beyond the control of the Unique Experience provider. In particular, where specific vehicles or celebrities are mentioned, the Unique Experience provider reserves the right to make reasonable substitutions made necessary by some act outside the control of the Unique Experience provider.

 

3.

If you wish to bring along spectators with you to your Unique Experience, please first check with the Unique Experience provider whether this is permissible. In most cases, it will be, although some providers may request a nominal payment for spectators. Please be aware that, like you, spectators are required to comply with the Unique Experience provider's terms, conditions and expectations of conduct.

 

4.

When enjoying your Unique Experience, you must behave in a safe and courteous manner, observe the proper instructions of any supervisor or activity leader, and dress and equip yourself in accordance with any advice you are given in connection with the Unique Experience. You must also use safety equipment as instructed and must not tamper with or abuse it. If you do, you will be liable to compensate London Marketing and/or the Unique Experience provider for any damage negligently caused by you.

 

5.

Please be aware that many Unique Experiences require a high level of concentration and the use of alcohol or drugs is strictly forbidden. If any customer or spectator is perceived to have been using alcohol or drugs the Unique Experience provider reserve the right to cancel your participation forthwith at its discretion and no refunds will be given.

 

6.

Please be aware that some insurance policies specifically exclude certain Unique Experiences. Therefore, before participating in a Unique Experience, please check your own insurance policy and arrange any additional cover desired.

 
 

Our liability to you

1.

Some of the Unique Experiences involve a degree of risk of physical injury or damage and you may be required to sign a disclaimer of liability in connection with your Unique Experience. If you refuse to sign such a disclaimer, we and/or the Unique Experience provider reserve the right to bar you from participating in the relevant Unique Experience and you will not be entitled to any refund.

 

2.

To the maximum extent permitted by law, London Marketing shall not be liable to you for any injury, loss (including but not limited to personal property), damage, delay, expense, inconvenience or otherwise suffered as a consequence of anything, howsoever caused, in connection with your chosen Unique Experience provider. For the avoidance of doubt London Marketing shall not (i) be liable in any way for anything howsoever caused in connection with unsuitable experiences being purchased and non-compliance with the Restrictions; and (ii) reimburse travel, accommodation or other incidental expenses incurred as a result of the cancellation of any Unique Experience.

 

3.

To the extent that London Marketing is held liable, London Marketing's liability shall not exceed the value of the goods and/or services contracted for.

 
 

Obligation to comply with foreign laws

1.

You shall comply with all laws of the country in which you are physically located and which apply to you when entering into the contract with your chosen Unique Experience provider, including without limitation consumer law and export control laws and regulations.

 
 

Data protection and you

1.

London Marketing is the data controller of your data. London Marketing is registered under the Data Protection Act 1998 (DPA) and London Marketing complies with the DPA in all our dealings with your personal data.

 

2.

When entering into a contract with your chosen Unique Experience provider, you consent to London Marketing processing your personal data to the extent necessary to ensure that your chosen Unique Experience provider can supply to you your Unique Experience. This processing will include, but not be limited to, passing on your personal information to your chosen Unique Experience provider for the purposes of enabling them to provide your Unique Experience to you. London Marketing makes no representation or warranties, and shall not be liable to you in the event that your chosen Unique Experience provider is not registered under the DPA and/or does not comply with the DPA in their dealings with your personal data.

 
 

Rights of Third Parties

1.

These Terms do not create any rights under the Contracts (Rights of Third Parties) Act 1999 ("Act") which are enforceable by any person who is either not a party to them or who is not your chosen accommodation provider.

 

2.

These terms and conditions shall be governed by and construed in accordance with the laws of England.

 

3.

You irrevocably submit to the exclusive jurisdiction of the courts of England to settle any dispute which may arise out of or in connection with these terms and conditions.

 

4.

Where relevant, you may print and keep a copy of these terms and conditions.

 

5.

If any part of these terms and conditions is held unenforceable, that part shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties, and the terms and conditions shall continue in full force and effect.
