OPEN TOP BUS TOURS

 

These are the terms and conditions which govern the provision of the goods and/or service to you.

 

London Marketing

1.

www.LondonTown.com (the "Website"), 0800 London and LondonTown.com kiosks are owned and managed by London Marketing.com Limited with registered company number 03189585 and VAT number 681614724 ("London Marketing"). London Marketing manages all information supplied through these channels.

 

2.

London Marketing can be contacted at 90 Long Acre, Covent Garden, London, WC2E 9RZ, telephone number 44 (020) 7494 2020 or via email on contact@londonmarketing.com.

 
 

Who you contract with

1.

You enter into a legally binding agreement with your chosen operator and not with London Marketing.

 
 

The point at which you contract

1.

Completing your booking form and submitting it to us amounts to an offer to contract. Such offer is accepted and a binding contractual agreement is entered into between you and the ticket vendor, when a booking confirmation number is sent to you. The act of sending the booking confirmation number is contractual acceptance.

 

2.

If you book online you will receive a booking confirmation voucher by email within 12 hours after your online booking is completed.

 

3.

If you book over the telephone, you will receive a booking confirmation number via your chosen means of communication.

 
 

When you pay

1.

You pay at the time of purchase and your credit card is debited by the tour operator on or shortly after you press the "Reserve Tickets" icon.

 
 

Your obligations if you do not receive a booking confirmation voucher

1.

If your chosen means of receiving booking confirmation is by email (you have no choice if you book online) and you do not receive a booking confirmation number within 12 hours after your online booking is completed, it is your responsibility to immediately contact us on customerservice@LondonTown.com or by telephone on 44 (020) 7437 4370.

 

2.

If your chosen means of receiving a booking confirmation number is via non-electronic means and you do not receive a booking confirmation number within 3 working days if you are in the UK and 14 working days if you are outside of the UK, it is your responsibility to immediately contact us on customerservice@LondonTown.com or by telephone on 44 (020) 7437 4370.

 
 

Your booking confirmation is important!

1.

Details of the booking, venue and ticket collection will appear on your booking confirmation. It is your responsibility to check all that the information in the booking confirmation is correct and to contact us immediately (time being of the essence) at customerservice@LondonTown.com or by telephone on 44 (020) 7437 4370 if it is not.

 

2.

You must have your booking confirmation number with you at the start of the tour, and if necessary, show it to the driver acting on behalf of your chosen operator.

 
 

The terms on which you contract

1.

Your chosen operator may supply you with a set of their own terms and conditions after you have placed your order with them. London Marketing has endeavoured to reflect your chosen operator's main terms and conditions herein but shall not be liable to you for any omission or failure to have done so.

 

2.

To the extent that your chosen operator's terms and conditions are inconsistent with these terms and conditions, your chosen operator's terms and conditions shall prevail.

 
 

Cancelling your booking

1.

In general, ticket purchases are non-refundable. However it may be possible, subject to availability, to change the date of your ticket by contacting us at customerservice@LondonTown.com or by telephone on 44 (020) 7437 4370.

 

2.

It is therefore your responsibility to check that all details submitted on the booking form and with the booking confirmation number are correct.

 

3.

If, for the period of the validity of your ticket, your chosen operator is unable to operate a service as a consequence of circumstances wholly within its control, we will provide you with a full refund. Lost or stolen tickets

1.

No replacements or refunds can be offered for lost or stolen tickets.

 

2.

It is your responsibility to look after your ticket. If you are found travelling without a valid ticket you will be charged the full hop-on, hop-off fare.

 
 

Children

1.

A child is defined as being aged 5-15 years.

 

2.

A child under 5 years may travel free as long as they are accompanied by an adult and do not occupy a seat to the exclusion of a fare-paying passenger.

 

3.

Children must be accompanied by an adult at all times.

 
 

Our liability to you

1.

To the maximum extent permitted by law, London Marketing shall not be liable to you for any injury, loss (including but not limited to personal property), damage, delay, expense, inconvenience or otherwise suffered as a consequence of anything, howsoever caused, in connection with the provision of the services.

 

2.

To the extent that London Marketing is held liable, London Marketing's liability shall not exceed the value of the goods and/or services contracted for.

 
 

Obligation to comply with foreign laws

1.

You shall comply with all laws of the country in which you are physically located and which apply to you when entering into the contract with your chosen cruise operator including without limitation consumer law and export control laws and regulations.

 
 

Data protection and you

1.

London Marketing is the data controller of your data. London Marketing is registered under the Data Protection Act 1998 (DPA) and London Marketing complies with the DPA in all our dealings with your personal data.

 

2.

When entering into a contract with your chosen cruise operator, you consent to London Marketing processing your personal data to the extent necessary to ensure that your chosen cruise operator can supply to you the cruise. This processing will include, but not be limited to, passing on your personal information to your chosen cruise operator for the purposes of enabling them to provide the cruise to you. London Marketing makes no representation or warranties, and shall not be liable to you in the event that your chosen cruise operator is not registered under the DPA and/or does not comply with the DPA in their dealings with your personal data.

 
 

Rights of Third Parties

1.

These Terms do not create any rights under the Contracts (Rights of Third Parties) Act 1999 ("Act") which are enforceable by any person who is either not a party to them or who is not your chosen cruise operator.

 
 

General

1.

You accept and hereby acknowledge that that use of the service is entirely voluntarily and at your own risk.

 

2.

Your chosen operator endeavours to provide departure points and times for the service which are as accurate as possible. However, your chosen operator reserves the right to cancel departures and/or vary such departure points and times without further notice to you and for any reason.

 

3.

Your chosen operator reserves the right to deviate from the route of service in the event of marches, parades, or where, in their opinion, it is reasonably prudent to do so in the light of all the circumstances.

 

4.

Your chosen operator may operate closed-top double-decker buses from time to time, especially in bad weather.

 

5.

For safety reasons you must remain seated on the upper deck whilst the bus is in motion.

 

6.

The consumption of alcohol is strictly prohibited on open top tour buses.

 

7.

Your chosen operator operates a hop-on, hop-off service, and therefore seats cannot be guaranteed on the tour.

 

8.

Your chosen operator reserves the right to cancel or abort a service or tour in cases where your behaviour is unsociable, dangerous and/or rude and/or if you fail to comply with any instructions issued with you confirmation number.

 

9.

These terms and conditions shall be governed by and construed in accordance with the laws of England.

 

10.

You irrevocably submit to the exclusive jurisdiction of the courts of England to settle any dispute which may arise out of or in connection with these terms and conditions.

 

11.

Where relevant, you may print and keep a copy of these terms and conditions.

 

12.

If any part of these terms and conditions is held unenforceable, that part shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties, and the terms and conditions shall continue in full force and effect.
